Article 1 – Purpose

The present conditions govern the sales by the company The 8 Shape of corsets and sculpting lingerie.

Article 2 – Price

The prices of our products are indicated in euros all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.

In case of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of The 8 Shape. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities.

All orders, regardless of their origin, are payable in Euros.

The 8 Shape reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time of the validation of the order and subject to availability.

The products remain the property of The 8 Shape until full payment has been received.
Attention: as soon as you take physical possession of the ordered products, the risks of loss or damage of the products are transferred to you.

Contractual information is presented in French language and will be the subject of a confirmation at the latest at the time of the validation of your order.

The 8 Shape reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in case of supply problems, or in case of difficulty concerning the order received.

Article 4 – Validation of your order

Any order appearing on the website www.the8shape.com implies adherence to these General Conditions. Any confirmation of order implies your full and entire adhesion to the present General Terms and Conditions of Sale, without exception or reserve.

All the data provided and the recorded confirmation will be worth proof of the transaction.

You declare to have perfect knowledge of them.

The confirmation of order will be worth signature and acceptance of the operations carried out.

Article 5 – Payment

The fact of validating your order implies for you the obligation to pay the price indicated.

The payment of your purchases is made by credit card through the secure system CHECKOUT PORTAL or PAYPAL.

The debit of the card is made only at the time of the validation of the order. In case of split deliveries, only the products shipped are debited.

Article 6 – Withdrawal

In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay a penalty.

Exchanges are to be made in their original state and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.

The costs of return are to be calculated according to the place of dispatch and the weight of the parcel and are at your expense.

In case of exercise of the right of withdrawal, The 8 Shape will exchange the corsets (only), within 14 days after notification of your request.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to :

  • The supply of services fully executed before the end of the retraction period and whose execution has begun after prior express agreement of the consumer and express renunciation of his right of retraction.
  • The supply of goods or services whose price depends on fluctuations in the financial market which are beyond the control of the trader and which are likely to occur during the withdrawal period.
  • The supply of goods made to the consumer’s specifications or clearly personalised.
  • The supply of goods which are likely to deteriorate or expire rapidly.
  • The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
  • The supply of goods which, after having been delivered and by their nature, are inseparably mixed with other items;
  • The supply of alcoholic beverages whose delivery is deferred for more than thirty days and whose value agreed upon at the conclusion of the contract depends on market fluctuations beyond the control of the professional.
  • The supply of audio or video recordings or computer software where they have been unsealed by the consumer after delivery.
  • The supply of a newspaper, periodical or magazine, except for contracts for subscriptions to such publications.
  • Transactions concluded at a public auction.
  • The supply of digital content not supplied on a physical medium, the execution of which has begun after prior express agreement of the consumer and express renunciation of his right of withdrawal.

Article 7- Availability

Our products are offered as long as they are visible on the website www.the8shape.com and within the limit of available stocks. For products not in stock, our offers are valid subject to availability from our suppliers.
In case of unavailability of product after placing your order, we will inform you by email. Your order will be automatically cancelled and no bank debit will be made.

In addition, the website www.the8shape.com is not intended to sell its products in large quantities. Therefore the company www.the8shape.com reserves the right to refuse orders for more than 5 identical items.

Article 8 – Delivery

The products are delivered to the delivery address indicated during the ordering process, within the period indicated on the order validation page.

In the event of a delay in shipment, an email will be sent to you to inform you of a possible consequence on the delivery time that has been indicated to you.

In accordance with the legal provisions, in the event of late delivery, you benefit from the possibility of cancelling the order under the terms and conditions defined in article L 138-2 of the Consumer Code. If in the meantime you receive the product, we will proceed to its refunding and to the expenses of routing under the conditions of the article L 138-3 of the Code of the Consumption.

In case of deliveries by a carrier, The 8 Shape cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several proposals for appointments.

Count approximately 4 days for the reception of the parcel in France, 7 days for Europe and from 8-10 days for other destinations.

The delivery time may be extended during holidays/public holidays/sales.

All our packages are sent by Colissimo.

Possibility of sending with DHL on request by contacting us by email or instagram.

Article 9 – Warranty

All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold (defect of an article), it may be returned, exchanged or refunded.

All claims, requests for exchange or refund must be made by email info@the8shape.com within 30 days of delivery.

The products must be returned to us in the state in which you received them with all the elements (accessories, packaging, instructions …). The shipping costs will be refunded to you on the basis of the invoiced price and the return costs will be refunded to you on presentation of the supporting documents.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

Article 10 – Liability

The products offered are in conformity with the French legislation in force. The 8 Shape cannot be held responsible in case of non-compliance with the legislation of the country where the product is delivered. It is up to you to check with the local authorities the possibilities of importing or using the products or services that you plan to order.

Furthermore, The 8 Shape cannot be held responsible for damages resulting from the misuse of the purchased product.

Finally, The 8 Shape cannot be held liable for any inconvenience or damage inherent to the use of the Internet, including but not limited to service interruption, external intrusion or the presence of computer viruses.

Article 11 – Applicable law in case of disputes

The language of this contract is the French language. The present conditions of sale are subject to French law. In case of dispute, the French courts will have sole jurisdiction.

Article 12 – Intellectual property

All elements of the website www.the8shape.com are and remain the intellectual and exclusive property of The 8 Shape. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express written consent of The 8 Shape.

Article 13 – Personal data

The 8 Shape reserves the right to collect personal information and personal data about you. This information is necessary for the management of your order, as well as to improve the services and information that we send to you.

The 8 Shape will archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the Civil Code.

The 8 Shape’s computerized records will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.

Privacy policy

We are the sole owners of the information collected on this site. Your personal information will not be sold, exchanged, transferred, or given to any other company for any reason, without your consent, other than what is necessary to respond to a request and/or transaction, such as to ship an order.

Conditions of return

The buyer has 14 days following the reception of the corset to ask us for an exchange if the corset is new and has not been worn. The corsets must be returned in the original pocket and in perfect condition. Buttock lifts and thong bodysuits are not exchangeable.

We do not make any refund.

Terms and conditions of exchange

We exchange corsets that would not be the right size if they have never been worn and are therefore neither dirty nor damaged.

We don’t trade for butt lifts and thong bodysuits.

We do not make refunds.
